The HOA is also concerned with keeping and maintaining peace within a community. These covenants cover general behavior, but can also cover highly specific things such as a door or housing color, yard maintenance, and a variety of other factors.

In addition to maintaining common areas, HOA’s also set out certain rules that all residents must follow called covenants, conditions, and restrictions (CC&Rs). Also,  common building rules may include what color front door you may have, whether you are allowed to line dry your laundry outside, whether you can have a satellite dish, the size and type of pets permitted, and so on. In many ways, these rules are similar to the kinds of rules apartment dwellers must follow.

In a subdivision with individual homes, regulations may include what color you can paint your home, the exterior landscaping you can do, the types of vehicles you can park on the street or in your driveway (no RVs, for example), permissible type and height of fences, and restrictions on window coverings for windows facing the street.

The rules are not intended to be ultimately restrictive, however, because of the communal nature of the HOA and the contracts that the homeowners have entered into as part of the terms and conditions of their property ownership, any deviations from the covenants need to be approved by the governing board of the HOA which can be a difficult and frustrating process.

There are significant benefits to being part of a community that has an HOA. One such benefit is that the HOA can serve as a non-biased arbiter between two homeowners that are involved in a dispute. This is beneficial in terms of not having to resort to the use of civil courts or law enforcement. Rules that are concerned with noise levels, air pollution (smoke), or even specific dog breeds can be enforced through the contract signed by the homeowners when they purchased their home. This contract grants enforcement rights to the HOA which can eliminate a protracted dispute between neighbors and therefore disturb the peaceful atmosphere of the neighborhood.

Another advantage that an HOA provides is that the responsibilities for maintaining the common areas don’t fall on a single individual. Activities like the upkeep of the common area landscaping or facilities maintenance are typically included as a part of the HOAs responsibilities and are paid for by the members of the community through their HOA fees.

One of the central attractions of the planned communities that utilize an HOA is that they offer recreational facilities that would usually be outside of the economic affordability of the individual, or at least would represent a significant financial burden for an individual. For example, community amenities such as parks, play areas, security fences and patrols, community pools, etc. can all be enjoyed by the members of the HOA by sharing the costs, and the labor, of maintaining those amenities.

The costs associated with merely an in-ground pool, alone, for a single homeowner is about $22,000. A pool that fits service a community would necessarily be even more expensive than that. By pooling the fees to the HOA, homeowners are able to leverage their collective wealth into having access to well-maintained amenities that would be outside of their economic price range, if they had to foot the bill by themselves.

The final advantage of an HOA is that it encourages homeowners to be active members of their communities. The HOA board is usually run by electing a member of the community, or several members of the community, to manage the neighborhood and observe the contractual obligations of the community.
